    The New Legislation for Professional Fertiliser End User Registration

    The Veterinary Medicinal Products, Medicated Feed and Fertilisers Regulation Act 2023 has recently been signed into law, and as of September 1st, the registration of Professional Fertiliser End Users and Fertiliser Economic Operators has come into effect. Under the new legislation, the Minister for Agriculture has the authority to attach conditions to registration, revoke or vary conditions, or impose new conditions.

    If the Minister believes that an applicant should not be entered in the register, they can refuse the application. Similarly, if a person entered in the register is found to be non-compliant with the law or a condition of registration, they can be removed from the register.

    The intention behind these provisions is to ensure that registrations are in compliance with the legislation and that those registered are following the requirements of the new rules. The Department of Agriculture has stated that safeguards are in place to allow the Minister to exercise this authority appropriately.

    It is important to note that since the enactment of the new provisions, no applications for registration have been refused among the 100,000 registrations that have taken place thus far. However, there is some confusion regarding the exact circumstances under which individual farmers may be excluded from the register. Denis Drennan, Deputy President and Chairperson of ICMSA’s Farm and Rural Affairs Committee, has called on the Minister to clarify this matter.

    In addition, Drennan has urged the Minister to simplify the recording of closing stocks of fertiliser each year. He proposes that unless a farmer declares otherwise, the Department should assume zero closing stocks for all farmers, as the majority will have no remaining fertiliser. Drennan believes that the current requirement for all farmers to make a return on this matter is unnecessary bureaucratic burden.
